Punxo Terms of Service

Punxo (the “app”) is provided by Alexandru-Gabriel Birchi (“Alex Birchi”), an individual based in Craiova, Romania (“Punxo”, “we”, “us”). Contact: support@punxo.com.

These Terms of Service (the “Terms”) are an agreement between you and us. By creating an account or using Punxo, you agree to them and confirm you have read our Privacy Policy. If you do not agree, do not use the app.

1. Entertainment, not assessment

Punxo is an entertainment game. You play short mini-games, and Punxo produces a playful personal “fingerprint” (trait scores and an archetype) that you can reveal, share, and compare with others. It also offers weekly picks and skill games with scoreboards among your connections.

Punxo is not a psychological, clinical, medical, diagnostic, or psychometric assessment. Its results are made for fun and are not a measure of your personality, abilities, health, compatibility, or worth. Do not rely on them, or on a Sync percentage, for any decision about yourself or anyone else (including hiring, education, relationships, or health), and do not treat them as professional advice.

2. Who can use Punxo

You must be at least 13 years old to use Punxo. By using it, you confirm that you are, and that the information you give us (including your birth year) is true.

If you are under 16, or under 18 where your country requires it, a parent or legal guardian must read and agree to these Terms and the Privacy Policy before you use Punxo, and the app asks you to confirm they did. By confirming, you and your parent or guardian accept these Terms, and the parent or guardian is responsible for your use of Punxo.

We delete accounts that belong to someone under 13, or to someone under 16 whose parent or guardian did not agree. A parent or guardian can ask us to delete their child’s account at any time by emailing support@punxo.com.

3. Your account

• You sign in with a one-time code sent to your email. Keep access to that email secure: anyone who can read it can sign in to your Punxo account.
• One account per person, for your own use. Do not share, sell, or transfer it.
• Tell us at support@punxo.com if you think someone else has used your account.

4. Your display name and content

• You choose your display name. It is shown to everyone who has your code, so do not use a name that is offensive, hateful, sexual, harassing, impersonates someone else, infringes someone’s rights, or is otherwise unlawful. We may remove or reset a name that breaks these Terms.
• You can add your Instagram, TikTok, or Snapchat username, which only people you are linked with see. Add only your own: the rules for display names apply to it too, and we may remove one that breaks them. What happens on those apps is governed by their own terms.
• You keep ownership of what you provide. You give us a non-exclusive, worldwide, royalty-free license to store, process, and display it only to run Punxo’s features (for example, showing your name and card to your connections), for as long as your account exists.
• You can share your card image outside the app. When you do, you are responsible for where you share it.

5. Other people

• Anyone who has your identity code can add you and see what the Privacy Policy describes. Share your code only with people you are happy to have see your card.
• You can block anyone, which removes you from each other’s lists and keeps them from adding you again, and you can report someone to us from their card. We review reports and may act on them (§8), but we do not monitor how people use Punxo and are not responsible for other users’ conduct, inside or outside the app.

6. Games, scores, and fair play

• Skill game scores and scoreboards are for fun. They carry no prize and no monetary value, and cannot be exchanged for anything.
• Play fairly: do not use bots, scripts, modified apps, emulated input, or bugs to set scores, make predictions, or gain any other advantage. If you find a bug, please tell us instead of using it.
• We check game runs on our servers and may remove scores or records, reset results, or suspend accounts that we reasonably believe were not earned by fair play.
• We may change, rotate, rebalance, or retire games, weekly events, and scoring at any time. Results already earned are kept as described in the Privacy Policy, but a ranking may change when we remove unfair scores.

7. Acceptable use

You agree not to:

• use Punxo for anything unlawful, harmful, harassing, threatening, or abusive;
• collect, scrape, or harvest other people’s data, or try to find people whose code you were not given (for example, by guessing codes);
• create accounts or play by automated means, or create several accounts;
• interfere with or overload Punxo or its infrastructure, or get around its security, rate limits, blocks, or age check;
• reverse engineer, decompile, or copy the app, except as the law expressly allows; or
• misrepresent who you are or impersonate others.

8. Suspension and termination

You can stop using Punxo and delete your account at any time in Settings → Delete account.

We may remove content, limit features, or suspend or close your account if you break these Terms, if the law requires it, or to protect Punxo or its users. Where reasonable, we will tell you why and give you a chance to respond, unless that would be unlawful or put others at risk. If you think we made a mistake, write to support@punxo.com.

Sections that by their nature should continue after your account ends (such as 9, 12 to 14, and 16) continue to apply.

9. Intellectual property

Punxo, including its games, design, archetypes, artwork, text, and branding, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose, on devices you own or control, in line with these Terms and the rules of the store you downloaded it from. If you send us feedback or ideas, we may use them freely, without any obligation to you.

10. Price

Punxo is currently free. If we offer paid features in the future, their price and terms will be shown in the app before you buy, purchases will be handled by the Apple App Store or Google Play under their terms (including refunds), and we will update these Terms first.

11. Health and safety

Some games use fast movement, quick color changes, and timed reactions. If you have epilepsy or are sensitive to flashing light, take care. Stop playing and take a break if you feel dizzy, unwell, or feel any discomfort. Never play while driving or when you need to pay attention to your surroundings.

12. Our responsibility for the app

We work to keep Punxo running well, but it is provided as it is and as available. We do not promise that it will always be available, free of errors, or that its results are accurate or meaningful (see §1).

If you are a consumer, you have legal rights that these Terms do not affect, including the statutory guarantee that digital content conforms to its description. Nothing here limits those rights.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profits, or goodwill, arising from your use of Punxo or from not being able to use it, and our total liability to you for any claim is limited to EUR 50.

These limits do not apply to liability that the law does not allow to be limited, including for death or personal injury caused by negligence, for harm caused intentionally or by gross negligence, or for fraud.

14. Apple and Google

If you downloaded Punxo from the Apple App Store:

• these Terms are between you and us, not Apple; we, not Apple, are responsible for the app and its content;
• your use is also subject to the App Store’s Usage Rules;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for the app;
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that it fails to meet any legal or regulatory requirement, and consumer protection or privacy claims;
• if a third party claims the app infringes its intellectual property, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim;
• you confirm that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and are not on any US Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded Punxo from Google Play, Google Play’s terms also apply, and Google is not responsible for the app.

Punxo also relies on other providers (listed in the Privacy Policy). We are not responsible for services outside our control.

15. Changes to Punxo and to these Terms

We may change, suspend, or end Punxo or any feature. We may update these Terms, for example when we add features or the law changes. We will tell you in the app or by email at least 30 days before a change that reduces your rights takes effect. If you do not agree, you can delete your account before then; continuing to use Punxo afterwards means you accept the new Terms. If we shut Punxo down, we will tell you in advance where we can.

16. Law and disputes

These Terms are governed by Romanian law. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country, and you can bring a claim in the courts of your country or of Romania.

If something goes wrong, please contact us first at support@punxo.com; most problems can be fixed quickly. Consumers in Romania can also contact the national consumer protection authority (ANPC, anpc.ro).

17. General

• If any part of these Terms is found invalid, the rest still applies.
• If we do not enforce a right straight away, we have not given it up.
• We may transfer these Terms to a company that takes over Punxo (for example, one we set up to run it), and will tell you when that happens; your rights under them stay the same. You may not transfer them.
• These Terms, together with the Privacy Policy, are the whole agreement between you and us about Punxo.
